I have read your replies to my colleague’s (Sue Clarke) communication with you. Be reassured she acted upon instructions and following conversations with myself.

 

To explain our position further and clarify, regardless of the right(s) of Angela Wild or any other party, if a claim is made that a property cannot or should be sold, we have a duty to qualify the situation.

 

As any such claim could prove unfounded, we would continue to market unless any information came to light that would suggest we should stop marketing.

 

Whilst you may have legal right to market the property, we have to know that should McDonald’s commit valuable resources to marketing a property and finding a suitable buyer that the buyer and ourselves can be sure than a sale is able to be successfully completed. As far as I can see having reviewed all the information you have kindly supplied to us, at it stands you have submitted an application to the court in September requesting the Court of Protection allow you to sell the property.

 

This sadly means that regardless of prior events and all opinion the property actually cannot be sold at the moment.

 

With all due respect to your comments and claims, we have therefore no choice but to now remove the property from the market.

 

If you any information to the contrary or should you obtain the relevant permissions, we would delighted to review our situation.

 

At this time we simply cannot continue to commit further precious resources to marketing where a sale is not possible as it cannot be legally completed.

WE can confirm the application to remove the restriction of disposition was sent recorded delivery on the 1st SEPT and signed for on the 2nd Sept 15 marked URGENT.

WE do not need permission to market the property.

 

Due to the fact other people were copied in to the email some needed to know the relationship that Angela Wild IS, there is no general alteration to your email & you are making a mountain out of a mole hill.

 

I seem to remember having difficulty with you once before & that was probably the reason we stopped dealing with you.

 

Please copy this email in to your respective boss.

 

WE can if you so wish market the property elsewhere.

 

If you care to check section 4 of the land register that I sent you which I hereby enclose a copy AGAIN

WHERE on here does it state that the property cannot be marketed??

 

The solicitors job on completion of sale will be to remove this restriction… if it has NOT ALREADY been removed?

YOU DO NOT NEED IT??  Currently!

Firstly I want to point out about the restriction on the land register, an application has been received by the COURT on the 2nd Sept 2015 to LIFT that restriction as it is considered VOID.

 

The very same JUDGE whom placed that restriction had no need to do so and we await a removal of such a restriction and here below is a copy of an email exchange with that very JUDGE who has also been copied in to this email.

YOU need to take full notes of the LIVING WILL that was made where in that you will see that my mother, STATE’s;

ANYONE further claiming any incapacity, her SON Me, steps in as her LIVING WILL executor.

 

The court are fully aware of this, and that this, places my authority as EXECUTOR over theirs, perhaps you may wish to check legalities??

 

Having demonstrated my authority, respectfully you may continue to market this property, whilst awaiting the courts removal of their restriction which is imminent.

 

You will appreciate having read my mother’s living WILL that my SISTER, ‘ANGELA WILD’ has no authority what-so-ever, to intervene or attempt to delay any such marketing.

 

YOU may of course confirm with courts if you wish DIRECTLY, that indeed they do have an application and that there is no problem in marketing the property.

WE would however, like to be kept notified of your correspondence with any other party.
